TERMS OF SERVICE

By commissioning the artist, you as the client accept my Terms of Service. Please read these terms carefully and thoroughly. They are meant to act as clear and concise guidelines for both the artist and the client, such that full and honest disclosure is ensured between both parties.
Violation of any of my Terms of Service will result in a ban from commissioning me again in the future.

GENERAL INFORMATION
1. These terms apply to personal use commissions only. This information is not applicable for commercial and/or promotional work.
2. I reserve the right to decline any commission offer.
3. I reserve the right to adjust any information on my commissions site, terms of service, and commission rates without prior notice.
4. Slots are filled up and prioritized by payment first basis.
5. All personal information between the artist and client will be kept private and confidential.
6. All prices listed on my commission sheet are base prices. Prices are subject to increase based on the complexity of the piece.
7. Note that I will share the finished artwork publicly and I will not mention you in the post for your privacy. Please let me know beforehand if you don’t want the artwork posted or if you want to be mentioned.PAYMENT
1. Currency accepted is either USD or PHP and can be paid through PayPal invoice or Gcash.PROCESS AND DELIVERY
1. I will notify you once I have started on your commission. Updates will be sent for every stage of the work process. During the updates, I will be reviewing the artwork with you and ask for your thoughts and any revisions before I move on to the next stage.
2. My work stages are commonly: draft, clean sketch, color layout, lines (if lined), flats, & rendering. Time spent on each stage of the process will vary depending on the artwork.
3. For clients queued on the waitlist, I will notify you once your commission is next in line on the list and give you an estimated time for when I can start on your commission.
4. The time it takes to finish your commission varies from 1 week to 2 months but also depends on the circumstance of the artist. Therefore, there is no absolute deadline unless specified by the client. If anything comes up that will slow the progress of the commission, I will let you know as soon as possible.
5. For commissions with a deadline, a rush fee may be added depending on the date agreed upon.
6. The finished artwork will be sent to the client via Google Drive link at its original resolution. Finished commissions in the past 2 months will be removed from the drive to make way for new ones. Note that there is no physical product.REVISIONS
1. You get 3 rounds of revisions included in the price. This is only applicable for the draft, clean sketch, and color layout stages. Revisions done after the color layout stage will be charged.
2. Additional revisions will be charged depending on the change you want me to make. I will make sure to inform you if a revision you want will be charged before going through with it.
3. Revisions that contradict previously approved changes will be charged. As much as possible, please have the artwork fixed during the initial phases.
4. A fee will be added if you want something changed on the final drawing – unless a misunderstanding from my side has been made.
5. I will not be responsible for any mistakes on the final version of any commission due to incorrect or missing information. It is the commissioner's responsibility to provide all relevant information when requesting a commission.COPYRIGHT / USAGE POLICY
I, Abigail Alfaro (the artist), reserve the full rights to the artwork and its distribution and use. Therefore, I am allowed to use the copyrighted artwork to do, but not limited to, the following:
• Promote myself with it everywhere.
• Publish books with it (art books, etc.).
• Display it everywhere to my liking (website, social media, portfolio, etc.).
• Post it anywhere online.
The artist is not allowed to:
• Claim any Intellectual Property (IP) that doesn’t belong to the artist.
• Make further direct profit out of the artwork.
The client is allowed, but not limited, to:
• Use the commissioned artwork for personal use.
• Print/reproduce any part of the artwork for personal use.
The following is considered copyright infringement:
• Reproducing/using any part of the artwork commercially - making money off it in any way.
• Claiming any part of the artwork as your own.
• Using any part of the artwork for advertising or profits associated with non-fungible tokens or cryptocurrency.
• Using any part of the artwork for promotional and/or advertising purposes. This includes, but not limited to, promotions for yourself, brands, and/or public figures.
• Altering/editing the artwork without the artist’s explicit permission.REFUND POLICY
1. If for any reason I am unable to start your commission, you will receive a full refund.
2. If you cancel your commission before I started it, you will receive a full refund.
3. Commissions that have been queued for at least 7 months will be automatically cancelled and will receive a full refund unless the client decides otherwise. Note that this only applies to commissions that have not yet been started.
4. Partial refund is available only until the color layout stage. Once you approve the color layout, you will lose all rights to a refund. Partial refund rates:
a. Draft/sketch stage – 50% Refund
b. Color layout stage – 20% Refund
5. If a commission has not been completed within 10 months since starting the commission, the client reserves the right to a full refund. This will not apply if the progress of a commission is delayed due to delays in the approval of the work stages.
What you will receive:
• Full resolution file of the final artwork sent via Google Drive, email or Discord. Default file format is A4, 300DPI, .png file & can be customized according to request.
• A signed and unsigned copy of the final artwork.
• A watermarked copy of the final artwork.
If the client breaks any of the points stated, they will lose all the before mentioned rights to the artwork commissioned from me, Abigail Alfaro (the artist), and I will have the right to profit further from the commissioned artwork in any way I see fit. If you have a problem with any of these statements, they may be changed if discussed with me prior to paying your commissioned piece.
